1. Acceptance of These Terms
By accessing or using https://srilankataxicharterservice.com/ (“Site”), you agree to be bound by these Terms of Use (“Terms”).
If you do not agree, please refrain from using the Site and our services.
2. Definitions
- “Company” / “we / us / our” – Sri Lanka Taxi Charter Service International Limited (CR No. 78456401, Hong Kong).
- “Service” – Online ground‑transport intermediary platform that connects travellers with government‑licensed drivers in Sri Lanka.
- “User / you / your” – Any individual who browses, submits an enquiry or completes a booking on the Site.
- “Driver” – Independent third party holding a valid Tourist Driver Licence issued by the Sri Lankan authorities.
3. Nature of the Service (Intermediary Role)
We act solely as an intermediary between Users and Drivers.
The transportation contract is formed directly between you and the Driver.
Accordingly, we do not provide carriage services and are not liable for the acts or omissions of Drivers, except to the extent required by law.
4. Eligibility
You must be (i) at least 18 years old, and (ii) legally capable of entering into binding contracts under the laws of your jurisdiction.
5. Booking & Payment
- Quotation – Base fare: JPY 15,000 for up to 100 km (vehicle + basic guide).
- Excess distance – JPY 2,000 per additional 10 km.
- Currency & FX – All card charges are denominated in Japanese Yen; we remit funds via PCI-DSS compliant payment processor and settle in Sri Lankan Rupees. Exchange‑rate risk is borne by the Company.
- Confirmation – A booking is confirmed only after full card payment and an e‑mail confirmation are issued.
- Receipts – Digital receipts are automatically sent to the e‑mail provided.
6. Cancellations & Refunds
More than 7 days (168 hours) before pickup — Full refund (less card processing fees).
3–6 days (72–167 hours) before pickup — 50 % refund.
Less than 48 hours before pickup / no-show — No refund.
Refunds will be credited to the original payment method within 10 banking days.
7. User Obligations
- Provide accurate passenger and itinerary information.
- Comply with local laws and Driver instructions on safety.
- Refrain from abusive language, unlawful conduct or carriage of prohibited items.
8. Prohibited Activities
You agree not to:
- Reverse‑engineer or misuse the Site;
- Post defamatory, obscene, or infringing content;
- Use the Service for commercial group tours without prior written consent.
9. Intellectual Property
All content on the Site (logos, text, graphics) is owned by the Company or its licensors and protected by international copyright and trademark laws. No portion may be reproduced without prior written permission.
10. Third‑Party Links
The Site may contain links to external websites. We are not responsible for their content or privacy practices.
11. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, whether express or implied (including fitness for a particular purpose, accuracy, or non‑infringement).
12. Limitation of Liability
To the maximum extent permitted by law, the Company’s total aggregate liability shall not exceed the Service fee paid for the booking giving rise to the claim.
We are not liable for: (i) indirect or consequential losses; (ii) acts or omissions of Drivers; (iii) delays due to traffic, weather, or force majeure events.
Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot be lawfully excluded.
13. Indemnity
You agree to indemnify and hold harmless the Company, its directors, employees and affiliates from any claims, damages, or expenses arising out of your breach of these Terms or misuse of the Service.
14. Modifications to the Terms
We may amend these Terms at any time. Material changes will be posted on this page with a revised “Effective Date”. Continued use after such changes constitutes acceptance.
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Hong Kong.
Any dispute shall be subject to the exclusive jurisdiction of the Hong Kong courts.
